Terms and Conditions of www.easy-fengshui.com

These Terms and Conditions govern your use of www.easy-fengshui.com ‘s website (the “Website”) and your relationship with www.easy-fengshui.com (“we” or “us”).  Please read them carefully as they affect your rights and liabilities under the law.  If you do not agree to these Terms and Conditions please do not register for or use the Website.  If you have any questions on the Terms and Conditions please contact info@easy-fengshui.com

1. Use of the Website

The Website is provided to you for your personal use subject to these Terms and Conditions.  By using the Website you agree to be bound by these Terms and Conditions.

2. Amendments

We may update the Terms and Conditions from time to time for legal or regulatory reasons or to allow the proper operation of the Website.  Any changes will be notified to you via the e-mail address provided by you on registration or via a suitable announcement on the Website.  The changes will apply to the use of the Website after we have given notice.  If you do not wish to accept the new Terms and Conditions you should not continue to use the Website.  If you continue to use the Website after the date on which the change comes into effect, your use of the Website indicates your agreement to be bound by the new Terms and Conditions. 

3. Registration


1. To register on the Website you must be over 18 years of age. 
2. You must ensure that the details provided by you on registration or at any time thereafter are correct and complete.
3. You must inform us immediately of any changes to the information you provided when registering by updating your personal details in order that we can communicate with you effectively.
4. The initial period of subscription on the Website will be 1 year from the date of receipt of your password. Following which time, you will require to re-subscribe to us.


4. Password and Security


1. When you register to use the Website you will be asked to create a password.  In order to prevent fraud, you must keep this password confidential and must not disclose it or share it with anyone.  If you know or suspect that someone else knows your password you should notify us by contacting info@easy-fengshui.com immediately. 
2. If we have reason to believe that there is likely to be a breach of security or misuse of the Website and/or your account, we may require you to change your password or we may suspend your account. 


5. Intellectual Property

The content of the Website is protected by copyright, trademarks, database rights and other Intellectual Property Rights.  You may retrieve and display the content of the Website on a computer screen.  However storage in any form, including electronic form, is strictly prohibited.  You may not reproduce, modify, copy or distribute or use for commercial purposes, any of the materials or content on the Website without written permission from us. 

6. Your Use of the Website


1. You may not use the Website for any of the following purposes:-


1. Disseminating any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material or otherwise breaching any laws;
2. Transmitting material that encourages conduct that constitutes a criminal offence or otherwise breaches any applicable laws, regulations or codes of practice;
3. Interfering with any other person’s use or enjoyment of the Website; or
4. Making, transmitting or storing electronic or hard copies of the materials protected by copyright without the permission of the owner.


2. You are solely responsible for the material you submit to the Website and by submitting any material you agree to follow these rules. You may not submit any material which;

3. contains links to any unlawful, threatening, abusive, defamatory or indecent material which is deliberately intended to upset other users;

7. has been submitted previously or is similar in content to work submitted previously.


3. You will be responsible for any losses, damages and costs resulting from your breach of this Clause 6. 


7. Availability of the Website


1. Although we aim to offer you the best service possible, we make no promise that the services on the Website will meet your requirements.  We cannot guarantee that the services will be fault free.  If a fault occurs with the Website you should report it to info@easy-fengshui.com and we will attempt to correct the fault as soon as we reasonably can.
2. Your access to the Website may be occasionally restricted to allow for repairs, maintenance or the introduction of new facilities or services.  We will attempt to restore the services as soon as we reasonably can.


8. Our Right to Suspend or Cancel your Registration


1. We may suspend or cancel your subscription immediately at our reasonable discretion or if you breach any of your obligations under these Terms and Conditions. 
2. You can cancel your registration at any time by informing us in writing at info@easy-fengshui.com.  If you do so you must stop using the Website.
3. The suspension or cancellation of your registration and your right to use the Website shall not affect either party’s statutory rights or liabilities. 


9. The Liability of www.easy-fengshui.com


1. We try to ensure that material included on our Website is correct, reputable and of high quality.  However, we do not make any warranties or guarantees in relation to that contact.  If we are informed of any inaccuracies in the material on the Website, we will attempt to correct the inaccuracies as soon as we reasonably can. 
2. We will only be responsible for any losses that you suffer as a result to the extent that they are a foreseeable consequence to both you and us at the time you used the Website.  Our liability shall not in any event include business losses such as lost data, lost profits or business interruption and shall be limited to the subscription price paid by you to us.
3. This clause 9 shall not limit or affect our liability resulting from any product or services sold through the Website being found to be unsafe or if something we do negligently causes death or personal injury.


10. Third Party Websites

As a convenience to customers, the Website may include links to other websites or materials which are beyond our control.  We are not responsible for content on any site outside the Website.

11. Advertising & Sponsorship

Part of the Website may contain advertising and sponsorship.  Advertisers and sponsors are responsible for ensuring that material submitted for inclusion on the Website complies with relevant laws and codes.  We will not be responsible to you for any error or inaccuracy in advertising or sponsorship material.

12. Applicable Law

These Terms and Conditions will be subject to the laws of Scotland.  We will try to resolve any disagreements quickly and efficiently.  If you are not happy with the way we deal with any disagreement and you want to take court proceedings, you must do so within the jurisdiction of the Scottish Courts. 

13. International Use

We make no promises that materials on the Website are appropriate or available for use in locations outside the United Kingdom, and accessing the Website from territories where its contents are illegal or unlawful is prohibited.  If you choose to access the Website from locations outside the United Kingdom, you do so on your own initiative and are responsible for compliance with local laws.

14. Pricing and Availability


1. Your credit or debit card will normally be charged at, or shortly after, the time that your order is placed. We reserve the right to change prices without notice.  Prices for all goods and services are listed on the Website.  Prior to finalising your order, you will be shown the total price for the goods and or services provided, inclusive of Value Added Tax. 
2. We will not accept any other form of payment other than credit or debit card.


15. Delivery of Training Programme


1. We will do everything we can to ensure that the training programme will be delivered to you promptly.  However, time shall not be of the essence in relation to our contract with you.  We shall not be liable for any delays caused by the inability of your e-mail address to accept any information sent to you by us which is required in relation to your ability to access the Website.  We will not accept any liability for any damage to software or other electronic faults in accessing the information.  You have the right to cancel your subscription to the Website at any time after you have subscribed to the Website until the date seven working days after you completed your subscription. 
2. You may exercise your right to cancel your subscription by writing to info@easy-fengshui.com, or by post to PO Box 10189, Dundee, DD4 9WB, Scotland, up to 7 days following your ability to access the Website.
3. If we have already charged your credit or debit card, we will refund any sums due within 30 days of your giving notice of cancellation.  If the training programme has already been accessed by you prior to your giving notice of cancellation, we reserve the right to refuse to refund some or all of your subscription. 
4. The right to cancel set out above is in compliance with the Consumer Protection (Distance Selling) Regulations 2000 and is in addition to your other statutory rights, which remain unaffected.


16. Data Protection


1. We will hold and use the information contained in your subscription for the purpose of processing your order and dealing with any subsequent enquiries relating to your subscription.  For security purposes we will delete records of your credit or debit card once it has been charged.
2. We will continue to hold your name, address and information about your purchases for internal management purposes so that we may improve upon the goods and services we provide.
3. We may from time to time inform you by mail, telephone, or e-mail about products or services which may be of interest to you.  We may also pass your name and address, e-mail address and telephone number to reputable companies so that they too can inform you about products or services which may be of interest to you.  If you prefer not to receive information in this manner please click on the relevant box on the sign up page and we shall not use your details in this way.


17. Licence to Use Material

By submitting material to the Website in terms of Article 6 above you are granting us a perpetual royalty-free non-exclusive licence to reproduce, modify, translate, make available, distribute and allow others to use any material you submit in whole or in part or in any form.   

18. Miscellaneous


1. You may not transfer any of your rights under these Terms and Conditions to any other person.  We may transfer our rights under these Terms and Conditions to another business where we reasonably believe your rights will not be affected. 
2. If you breach these Terms and Conditions and we choose to ignore this, we will still be entitled to use our rights and remedies at a later date or in any other situation where you breach the Terms and Conditions. 
3. We shall not be responsible for any breach of these Terms and Conditions caused by circumstances beyond our reasonable control.
